Technical instructions on air quality

Technical instructions on air quality issued by the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety.First general administrative regulation on the Federal Immission Protection Law (technical instructions on air quality) of July 24, 2002.

These technical instructions allow for the protection of the general public and the neighborhood against environmental impacts caused by air pollution and for precautions to be taken with regard to harmful environmental impacts caused by air pollution in order to achieve a high level of protection for the whole environment.

The stipulations made in these technical instructions must be observed for:

  • when reviewing applications for the building permission and operating permission of new plants (§ 6 section 1 BImSchG) as well as when changing the location, structure or operation of an existing plant (§ 16 section 1, also in association with section 4 BImSchG),
  • when considering applications for partial permission, advance notice or the approval of early commencement (§§ 8, 8a and 9 of the Federal Immission Control Act),
  • when considering whether permission is required for a change (§ 15 section 2 of the Federal Immission Control Act),
  • for the decision on additional stipulations (§ 17 of the Federal Immission Control Act),
  • when deciding on stipulations regarding the calculation of the kind and extent ofemissions from a plant as well as the immissions in the area affected by the plant (§ 26, also in association with § 28 of the Federal Immission Control Act).

The protection against harmful environmental impacts caused by odor immissions is not regulated in these administrative instructions; however the precautions to be taken against harmful environmental impacts caused by odor immissions are regulated in these administrative instructions.
